These General Terms and Conditions of use of the website and purchase of products/services of our online store (hereinafter the "Terms of Use and Transactions" or the "Terms of Use"), define the terms and conditions of your browsing and use of our website and our online store and govern the sales contract concluded between us for the purchase of products from our online store.
Before you enter our online store we invite you to consult the 'Terms and Conditions of Use and Transactions' and ensure that you agree to them.
If you disagree with any of these Terms of Use, you must refrain from taking any action on both our Website and our online store, including simply browsing our online store.
However, any action you take on our online store, such as but not limited to browsing it, subscribing to our Company's newsletter, or purchasing our products, shall be deemed to be your unconditional acceptance of these Terms of Use and Transactions.

twerk.gr, reserves the right to unilaterally modify or renew these Terms of Use at its sole discretion and/or when the modification is required by law, possibly without prior notice to you, but always within the limits of business ethics and the limits set by law.
Twerk.gr, undertakes to inform you of any modifications and any changes through the Website. Any amendments will be effective from the date of their posting on this Website.
It is clarified that any change to these Terms of Use does not include orders that you have already carried out in our online store, before the entry into force of the amendments in accordance with the above.
Your use of twerk.gr after the aforementioned amendment is deemed to be acceptance of the Terms of Use as amended.

II. WEBSITE SERVICES - ONLINE SHOP

Α. PROVISION OF INFORMATION

The information provided by this Website is complete, true, valid and up-to-date, whether it relates to our identity or to the products/services provided by our online store.
The above warranties are subject to any technical or typographical errors, which cannot be foreseen or have occurred unintentionally or due to interruptions in the operation of this website or even due to force majeure.
Twerk.gr has taken all the necessary technical and other means to update immediately the available quantity and sizes of our products, however, reserves an express reservation regarding the validity of the quantities and sizes of products available in the online store, since the update may take place within one (3) days from the time of their modification.

Β. MEMBER REGISTRATION

Your registration as a Member of twerk.gr is desirable but not necessary in order to make a purchase from our Online Store.
By entering your requested personal data (first and last name, address, postal code of your current primary residence, telephone number, current email address, gender and date of birth) and accepting these Terms of Use and Transactions, you become a Member of twerk.gr.
Registration and membership is free, personal, non-transferable and unregistered.
You are responsible for the information you provide to us and twerk.gr relies solely and exclusively on your statements regarding your personal information.
The personal data you provide us with when you register as a Member, our Company processes them exclusively for this purpose:

(b) To communicate with you regarding your transactions between us (e.g. to ensure that we can communicate with you, to complete, send and deliver your order, to ensure payment and secure our financial transaction).
You have the possibility, at any time, to access your data, or you can also at any time request the immediate deletion or correction of your data, the temporary non-use of your data by twerk.gr, the blocking or non-transmission of your data, by following the same above mentioned procedure of sending an email to us.
In any case, however, your data are kept by our Company only for as long as you are a registered Member of twerk.gr.
Your personal data are not communicated to any third party and are managed exclusively by twerk.gr.
All your personal data, which are collected through the special online form of twerk.gr are absolutely necessary for the performance of the above services and your registration indicates your full consent.
With regard to the collection and processing of your personal data, the terms and provisions of the Privacy Policy of twerk.gr apply.
twerk.gr does not provide third parties with information about your first name, surname, home address or other personal data.

C MAKING A PURCHASE THROUGH THE SHOP
1. ORDER

1.1.

You can complete your order as a visitor or as a member.
During the completion of your order the system will automatically guide you through the very simple and quick registration process.
If you wish to make your purchase as a guest, your details will not be stored for any future use (except for tax authorities).
To complete the order you must select a payment method from those available and accept these terms and conditions.
The prices listed on our products are inclusive of VAT and are considered final.
Shipping and COD charges, if incurred, are added to the final payment amount and are clearly indicated on the final order form, which we will send to your email address.
Upon submission of your order, we will send a message to the email account you have provided us with, which will notify you:
That we have received the order.
The products you have ordered.
The shipping and COD charges, if any.
The payment method.
And all the terms of the order.

1.2.

Cancellation of your order may be made:

1.2.1. Before the order is completed.

Before you submit your order, you technically have the option to "return to cart" and remove the quantities of products from your cart that you do not wish to order by clicking on the "remove" button.

1.2.2 After the order is completed but before the products are received.

If the online order has been completed but not yet shipped, you can cancel it by sending an email to info@twerk.gr.

1.2.3. Upon receipt of the order.

Any refusal by you to receive your products upon delivery by the Carrier shall be equivalent to your right of refund but you have to pay the return shipping fees of the product(s), which will exclude from the refund.

1.2.4. After receiving the order, due to error, due to defective products, due to loss.

After receipt, your order is cancelled if you receive a defective product, the wrong product (not included in the final order form) or never receive a product due to loss.

 2. SHIPMENT AND DELIVERY OF PRODUCTS

2.1 Shipping costs.

The shipping of the products in your order is subject to shipping charges (if any) which are added to the final payment amount and are clearly indicated on the final order form.

2.2.

The days of delivery of your products are determined by the operating hours of the transport company that undertakes their transport and is made at the place of delivery that you have indicated in your order form.

2.3 Delay in delivery.

Our Merchant will make every effort to ensure the timely and proper delivery of your products, however we reserve the right to delay the delivery of your product(s) in some special cases.

3. METHODS OF PAYMENT

3.1 Payment by Paypal

You can pay the value of your order and any costs incurred, as indicated in your order form (e.g. shipping costs), with Paypal (by choosing payment with Paypal you have the option to pay either with your Paypal balance or with your credit or debit card).

3.2 Payment by Debit or Credit card

We use Stripe provider in order to pay with any debit or credit card you wish, all transactions are fully protected with encryption.

3.3 Payment by deposit to a Bank Account.

You can pay the value of your order and any costs that may arise by depositing into a bank account of our company.
For your convenience, please indicate the code of your order when depositing the amount.

twerk.gr does not handle the personal information, including credit card numbers and bank account numbers, of users who choose Paypal, Debit or Credit Card Payment, or, Payment by Bank Account Deposit.
These processes are protected from any unauthorized access or disclosure, loss or misuse, and alteration or destruction, by the financial institutions processing the transactions.

Users' connection to twerk.gr is secure because it uses SSL  technology with encryption.
SSL technology relies on a key code to encrypt data before it is sent over the (SSL) connection.
The security check between the data and the server is based on the unique code key, fully securing the communication.
The SSL (Secure Sockets Layer) protocol is currently the global standard on the Internet for authenticating web sites to network users and for encrypting data between network users and web servers.

4. WITHDRAWAL/REFUND - CANCELLATION OF ORDER

4.1. Conditions for exercising the right.

You have a period of fourteen (14) days to withdraw/refund from any purchase you may have made through our online store,
in case you changed your mind and the product is in the same condition that you received then you have to pay the costs of returning shipping. In case the product is damaged, then you will get a full refund without paying the shipping costs but you have to prove to us that the product is damaged, sending to us a photo of the product instantly when you open the package, otherwise you do not have the right to get any refund.
The right of refund is exercised when you want to return the product you purchased from our online store, and get your money back.
The aforementioned period of fourteen (14) calendar days for exercising the right of refund begins on the day of shipping of product(s).

4.3 Consumer obligations upon withdrawal.

In order to comply with the withdrawal period, you must send us your declaration of exercise of your right of withdrawal by email to info@twerk.gr before the withdrawal period expires.
It is expressly agreed that your notice of exercise of the right of withdrawal shall be deemed to have been received by us on the next business day after you have given us notice of withdrawal as set out herein.
If you exercise your right of withdrawal in accordance with the above, you must return to us the product from which you are withdrawing immediately, without delay.
For returns of products, the cost of returning the products is borne by you, unless they are damaged or defective products that we have sent to you, in which case the cost of returning them is borne by us.

4.5. Return of Products.

We are entitled to delay your refund until we receive back the goods which you have withdrawn from the purchase in the same good condition in which you received them.
In the event of a withdrawal in accordance with the above, it is clarified that any products which you have purchased with a discount due to the purchase of the product from which you are withdrawing, you must return them together with the main product from which you are withdrawing, otherwise the withdrawal shall be deemed to have been unexercised by you and therefore no obligation shall be incurred by us.
You acknowledge and agree that you are responsible for any reduction in the value of the products you return, which (reduction) occurs as a result of your handling of the products in question, other than that necessary to ascertain the nature and properties of the products.
However, it is clarified that in order to get your money back in the case of withdrawal, the product must be in the perfect condition received without damage and complete, in its original packaging and accompanied by all relevant documentation and proof of purchase.
All returned products must be in perfect condition, not tampered with in any way and must have the special label of marking, otherwise returns will NOT be accepted.
The returned product must be accompanied by all the necessary documents that you received upon receipt, otherwise twerk.gr does not receive them since you agree that the right of withdrawal has not been legally exercised and in accordance with the terms of this.

In the case of return due to an error in your assessment (color, size, etc.), the products are not exchanged for money and the shipping costs and replacement costs are borne by you.

In the case of returning proven defective products, the shipping costs are borne by us.
In the event that the product to be returned,
a) is not proven to be defective,
b) it is found to have been used.

III. RESPONSIBILITIES - OBLIGATIONS OF THE PARTIES
Α. LIABILITY OF USERS OF THE WEBSITE AND CONSUMERS OF THE ONLINE SHOP

1. Exclusive Liability of the User/Consumer.

You are solely and exclusively responsible for the lawful use of the Website and the Online Store and you are required to refrain from any illegal acts and abusive conduct and from adopting illegal practices and unfair competition practices.
Participation as a member is only possible for natural or legal persons with full legal capacity. Minors (persons under 18 years of age) are excluded from obtaining membership.
You are solely responsible for the legality and correctness of the Information, Data and data you provide to twerk.gr, which the Company has no responsibility or obligation to control, unless it is imposed upon it after a complaint or by law.

2. Prohibited Uses.

It is forbidden to use the Website and the online store twerk.gr for sending in any way, publication, transmission of any content that is illegal, threatening, offensive, abusive, defamatory, immoral, vulgar, obscene, reinforces or expresses racial, ethnic or other discrimination, may cause harm to third parties in any way.

 Β. LIABILITY twerk.gr

1. Supplier's Liability and Warranty.

The manufacturer of any product you purchase is liable for any damage caused by a defect in its product. Any agreement to limit or relieve the producer of his liability is void.
In case of doubt as to the identity of the producer of a product you have purchased from us, please let us know.

2. Liability of twerk.gr for defects, loss.

twerk.gr has towards you all the obligations provided for in the Civil Code for the seller. In particular, in the event of a defect in the product we sell you, you may (a) request its repair at no charge to you, unless this is impossible or requires disproportionate costs or (b) replace it with another (see Section II.D.6) or (c) withdraw by following the procedure in Section I.D.5.2.
The above obligations of our Merchant cease in the event that the defect has been caused by you, or the returned product bears dirt, wear and tear, abrasions, creases and generally gives the impression that it has been subjected to use beyond what is necessary to establish its suitability, or by force majeure in a narrow or broad sense.
In all cases the products must be accompanied by the necessary legal documents and proof of receipt. You must exercise the above rights within fourteen (14) calendar days from the receipt of your products, this period starting from the day following the receipt and in any case within this period you must have returned the product to us.

We further inform you that the risk of loss or damage to the products is borne by twerk.gr until you or a third party which you designate as responsible to receive the products on your behalf (other than the carrier) has acquired physical possession of the goods, in which case this risk is transferred to you.
However, the risk is transferred to you by the delivery of your purchased goods to the carrier if the carrier has been instructed by you to transport the goods and this option was not offered by twerk.gr, without prejudice to your rights against the carrier.

3. Limitation of Warranties-Liability.

twerk.gr always acts in good faith and within the framework of the law and these General Terms and Conditions.


Furthermore, twerk.gr does not provide any guarantee (a) for the suitability, effectiveness, adequacy of its products with regard to the purpose for which you intended it and (b) for the correct and proper performance of the transactional obligations of the other Users of the website and its services.

twerk.gr makes reasonable efforts to ensure the maintenance and availability of its content.
Nevertheless, Users accept that funky-man.gr is entitled to modify and/or temporarily or permanently suspend all or part of the Website with and/or without notice to Users, since availability may be affected by Users' equipment, by other communication networks, by the large number of people trying to use the Website at the same time or by other causes.

Therefore, twerk.gr does not bear any responsibility for any kind of damage (positive, consequential, negligent, intracontractual or other) resulting from the inability of users to access it, the cessation of all or part of it, the delay, non-delivery, interruption or poor quality of reception of its services or loss of their content, the existence of any kind of errors.

The twerk.gr is not responsible for any technical problems that may occur to users when they attempt to access the website and during the course of this and are related to the operation or compatibility of their own infrastructure with the use of the website.

Also, twerk.gr has no responsibility for acts or omissions of third parties and especially unauthorized interventions of third parties in products and / or services and / or information available through it.

twerk.gr is entitled to temporarily or permanently exclude a member at any time and without stating the reasons, i.e. to cancel/delete/prevent access and/or participation of a member (temporarily and/or permanently) without any claims against twerk.gr. It is understood that such member is prohibited from becoming a member of twerk.gr again with the same or different data unless twerk.gr expressly agrees to this. To this end, the member consents to twerk.gr retaining his/her personal data in its system in order to be able to identify any subsequent attempt to register him/her.

twerk.gr reserves the right at any time, without justification and without compensation, to interrupt or cease the provision of its services and/or its operation permanently or temporarily without any obligation to inform the members in advance. twerk.gr shall only be liable for direct damages, which arise due to fraud or gross negligence on the part of twerk.gr.
Without prejudice to mandatory provisions, twerk.gr's liability for direct damage due to slight negligence is expressly excluded, irrespective of the legal grounds. The liability of twerk.gr for indirect or consequential damages is completely and expressly excluded - irrespective of the cause.

IV. INTELLECTUAL PROPERTY RIGHTS

All the content of the web pages of this website, including images, graphics, photographs, drawings, texts, services and products are the intellectual property of twerk.gr and are protected by the relevant provisions of Greek law, European law and international conventions and treaties.

1. DEFINITION OF PERSONAL DATA

Personal Data is any information relating to the data subject, i.e. any natural person to whom the data refer and whose identity is known or can be ascertained.
Such information includes, for example, the name, address, date of birth and gender of the member, mobile phone number, e-mail address and usage data, such as, for example, member name, password and IP address. (Law 2742/1997, Law 3471/2006, as applicable and the relevant provisions.)

2. PERSONAL DATA WE COLLECT.

During your visit to our Website and Online Shop and in order to a) register as a member of twerk.gr and open an Account, b) subscribe to the Newsletter Service of twerk. gr, c) to ensure that we can contact you in order to inform you about your orders and new products, d) or to exercise your rights according to the law and the General Terms of Use, you may be asked to provide information about yourself (such as name, surname, email address, shipping address, date of birth, date of birth, address sheet, telephone number, debit or credit card details, etc.)

In addition, in order to send you short SMS text messages with newsletters about the Company and its products/services, we ask you to provide us with your mobile phone number.

3. IP ADDRESSES

The IP address through which the computer has access to the Internet and then to twerk.gr, is used exclusively for the collection of statistical data and the security of transactions.
